Welcome to RoomieFinder ("we," "our," or "us"). By accessing or using our website, mobile application, or services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

RoomieFinder is a platform that connects individuals seeking roommates and accommodation. Our Service includes:

• Roommate matching based on compatibility criteria
• Property and room listings
• Messaging and communication tools
• Profile creation and management
• Search and discovery features

3. User Accounts

3.1 Account Creation

To use certain features of our Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Be responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3.2 Account Eligibility

You must be at least 18 years old to create an account and use our Service. By creating an account, you represent and warrant that you meet this age requirement.

4. User Conduct

You agree not to:

• Provide false, misleading, or fraudulent information
• Impersonate any person or entity
• Harass, threaten, or harm other users
• Use the Service for any illegal or unauthorized purpose

5. Listings and Content

5.1 User-Generated Content

Users may post listings, profiles, messages, photos, and other content ("User Content"). You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content in connection with operating the Service.

5.2 Content Standards

All User Content must comply with our content policies. We reserve the right to remove any content that violates these Terms or is otherwise objectionable.

5.3 Accuracy of Listings

If you post a property or room listing, you represent and warrant that:

• All information in your listing is accurate and up-to-date
• You have the legal right to list the property
• Photos accurately represent the property
• Pricing information is correct and transparent

6. Safety and Verification

While we strive to create a safe community, we do not conduct background checks on users. You are responsible for:

• Conducting your own due diligence before meeting or transacting with other users
• Meeting in public places for initial meetings
• Not sharing sensitive personal or financial information prematurely
• Reporting suspicious or inappropriate behavior to us immediately

7. Payments and Fees

RoomieFinder may charge fees for certain services. Any applicable fees will be clearly disclosed before you incur them. All fees are non-refundable unless otherwise stated.

Important: RoomieFinder does not process rental payments or security deposits. Any financial transactions related to housing arrangements are between users and must follow local laws.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

9. Intellectual Property

The Service, including its design, functionality, text, graphics, logos, and software, is owned by RoomieFinder and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee:

• The accuracy or reliability of User Content
• That the Service will be uninterrupted or error-free
• That you will find a suitable roommate or accommodation
• The conduct or reliability of other users

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROOMIEFINDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months prior to the claim, or €100, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless RoomieFinder, its affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another party

13. Termination

We may suspend or terminate your account at any time, with or without notice, for any reason, including if we believe you have violated these Terms. You may also delete your account at any time through your account settings.

Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on our website and updating the "Last Updated" date. Your continued use of the Service after changes become effective constitutes your acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Madrid, Spain.

16. Dispute Resolution

If you have a dispute with us, please contact us first at support@roomie-finder.com so we can attempt to resolve it informally. If we cannot resolve the dispute within 30 days, either party may pursue formal legal action.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
